Welcome to GiftPilot, operated by Gift Pilot Services (“GiftPilot”, “we”, “our”, or “us”).

These Terms & Conditions govern your use of the GiftPilot website, mobile application and related services. By accessing or using GiftPilot, you agree to be bound by these Terms.

1. About GiftPilot

GiftPilot is a subscription-based gifting service that helps users manage special occasions by providing personalised gift recommendations, reminders and gifting assistance.

2. Eligibility

To use GiftPilot, you must:

• Be at least 18 years of age.

• Provide accurate and complete information.

• Maintain the security of your account credentials.

You are responsible for all activity that occurs under your account.

3. Subscriptions

GiftPilot offers subscription plans for both personal and business users.

Your subscription provides access to the features included within your selected plan.

Subscription fees are charged in advance on a recurring basis until cancelled.

4. Payments

Subscription payments are securely processed by Stripe.

By subscribing, you authorise Stripe to charge your selected payment method for your subscription fees.

GiftPilot does not store your payment card details.

5. Cancellations

You may cancel your subscription at any time.

If you cancel your subscription, you will continue to have access to your subscription benefits until the end of your current billing period.

No partial refunds are provided for unused portions of a subscription unless required by law.

6. Gift Recommendations

GiftPilot uses information you provide to generate personalised gift recommendations.

Recommendations are intended as suggestions only.

During the initial release of GiftPilot, some recommendations and gift fulfilment may include manual review while we continue improving the service.

Although we aim to provide relevant recommendations, GiftPilot cannot guarantee that every recommendation will meet individual preferences or availability.

7. Gift Purchases

Where GiftPilot purchases or arranges gifts on your behalf, purchases are made using the information and budget you provide.

Product availability, pricing, delivery times and retailer policies are outside GiftPilot’s control and may change without notice.

If a recommended product becomes unavailable, GiftPilot may recommend or arrange a suitable alternative.

8. User Responsibilities

You agree to:

• Provide accurate information.

• Ensure recipient information is correct.

• Obtain permission before sharing another person’s personal information.

• Use GiftPilot only for lawful purposes.

9. Intellectual Property

All content, branding, graphics, logos, software and intellectual property associated with GiftPilot remain the property of Gift Pilot Services unless otherwise stated.

You may not reproduce, copy or distribute any part of GiftPilot without our written permission.

10. Limitation of Liability

To the maximum extent permitted by law, Gift Pilot Services shall not be liable for any indirect, incidental or consequential damages arising from the use of GiftPilot.

Our total liability for any claim relating to the service shall not exceed the amount paid by you for your current subscription during the previous 12 months.

Nothing in these Terms excludes any rights that cannot legally be excluded under applicable consumer laws.

11. Availability

We aim to provide a reliable service but cannot guarantee uninterrupted availability.

GiftPilot may occasionally be unavailable due to maintenance, updates or circumstances beyond our control.

Your use of GiftPilot is also governed by our Privacy Policy.

13. Changes to These Terms

We may update these Terms & Conditions from time to time.

The latest version will always be published on this page with the updated effective date.

Continued use of GiftPilot after changes have been published constitutes acceptance of the updated Terms.

These Terms & Conditions are governed by the laws of Australia.

Any disputes arising in connection with these Terms shall be subject to the jurisdiction of the Australian courts.
